The Department of Justice has opened an investigation into Secretary of Labor Alex Acosta's role in negotiating a controversial plea deal with a wealthy New York investor accused of molesting more than 100 underage girls in Palm Beach.

The probe is in response to a request by Sen. Ben Sasse, a Nebraska Republican and member of the Senate Judiciary Committee, who was critical of the case following a series of stories in the Miami Herald. The Herald articles detailed how Acosta, then the U.S. attorney for Southern Florida, and other DOJ attorneys worked hand-in-hand with defense lawyers to cut a lenient plea deal with multimillionaire Jeffrey Epstein in 2008.

Epstein, 66, could have faced a possible life sentence for sex trafficking, but instead was secretly granted federal immunity, along with others who were part of the conspiracy, some of whom were named, others not.

Epstein was suspected by the FBI of running an international sex trafficking operation involving minors, and federal prosecutors had drafted a 53-page indictment that was shelved after Acosta signed off on a non-prosecution agreement in September 2007.

For months after the deal was executed, federal prosecutors kept Epstein's victims in the dark, and the FBI led some of them to believe the investigation was ongoing. Most of the girls, ages 13 to 16 at the time, found out about the plea bargain only after learning about it on television when Epstein was sentenced in June 2008.

Acosta agreed to seal the agreement and keep it from Epstein's victims so that the girls couldn't try to derail it before he was sentenced, the Herald found.

Epstein's agreement called for him to serve 18 months in the Palm Beach County jail and to register as a sex offender. But even in jail, Epstein received liberal work release privileges that required him to spend little time in a cell. Six days a week, he was picked up at the jail by his private driver and driven to an office in downtown West Palm Beach, where he spent up to 12 hours a day greeting friends, lawyers and several young women who were named by federal prosecutors as participants in his sex trafficking scheme.

Ultimately, he served 13 months on two prostitution charges and was released in 2009.

Pak said that because Congress did not outline specific penalties in the Crime Victims' Rights Act when it was created by Congress, Epstein's victims have no right to demand anything from the government - not even an apology. A federal judge ruled earlier this year that the plea deal violated that legislation.

In the filing, federal prosecutors did concede that the U.S. Attorney's Office in South Florida failed to treat Epstein's victims - most of whom where 13 to 16 years old when they were victimized - fairly, but they said that the law gives prosecutors discretion in deciding how to dispose of a case. Victims have a right to confer with prosecutors, but no rights beyond that, Pak said.

(So, per another ridiculous argument by Trump's DOJ, victims have a "right" to confer with prosecutors, but no rights to recourse when prosecutors make a secret deal and deny the victims access and input.)

Also, Epstein's lawyers got his plea on lesser charges so there is a very strong argument that any other charges arising out of those time frames and transactions would be double jeopardy. This case is so dirty and so much money changed hands without a trace that you almost have to respect the sheer audacity and success of it. I know some of the attorneys for the state court case and they charged well over a million for each attorney. They were able to create a 501c3 corporation that Epstein was able to say he was employed by for his work release. Epstein did not personally give any money to PBSO Ric Bradshaw, his very wealthy friends did and that dirty little "Friends of PBSO" slush fund now exists as a political scorekeeper in the form of a private fund for Ric Bradshaw's discretionary use in "budget gaps" or shortfalls.

Judge William Jung of the Middle District of Florida dismissed Johnson's lawsuit in June, but video of the kiss was released by Trump's lawyers on Wednesday.

Giuliani said he believed the case was indicative of people spreading unsubstantiated claims against the president.

"The whole Mueller investigation was infused with that. ... They printed the wildest, craziest lies, and of course they had never apologized for it," he claimed. "People feel empowered to say anything they want."

According to Politico, Jung tossed out Johnson's complaint last month and said in his 15-page order that "the complaint presents a political lawsuit, not a tort and wages lawsuit."

Jung added, "If plaintiff wishes to make a political statement or bring a claim for political purposes, this is not the forum."
Johnson was director of outreach and coalitions for the Alabama GOP primary in 2016 and later did similar work in Florida.

The former staffer told MSNBC in February that in August 2016, she briefly interacted with Trump on an RV during a campaign stop in Florida. Before he stepped off the vehicle to speak with campaign interns, she told him to "Go kick ass" and said she hadn't seen her family in a very long time. Johnson said Trump held her hand and began getting closer.

"This accusation is absurd on its face. This never happened and is directly contradicted by multiple highly credible eyewitness accounts," then-White House press secretary Sarah Sanders said in February.

Hassan Zavareei, a lawyer for Johnson, said in a statement to the Washington Post the video "corroborates exactly what Alva said."
"Now, whether or not everybody would have felt violated by that is an open question. But Alva was. And she testified exactly why she felt uncomfortable. She testified that she didn't really know how to react when it happened and that she was confused and uncomfortable," he wrote Thursday. "After Access Hollywood came out, Ms Johnson was able to put in context exactly what Trump had done to her and what it meant. Indeed he told her himself, in his own words, exactly what that kiss was."
