No, that won't matter at all. If he didn't have a cop sitting on his neck, he would still be alive today. Then there is the conflicting ME report. That's strike two.

This trial will be a disaster. Right now, I haven't heard many of the facts. The pictures I've seen look horrible but I'm sure there is more to the story.

Depending on what details emerge, this judge could be put in a really tough spot. The judge is probably hoping that this is the worst cop who has ever lived.

It is pretty clear cut and evidenced by video from multiple angles. The man was crushed to the ground by the weight of several grown men with knees on his back and neck. They slowly watched him die despite his pleas that he couldn't breathe and the pleas of bystanders that they were killing him. There was absolutely no reason period for that. People keep saying the bystanders should have been done something, but really what the hell are they going to do with armed police officers there?
