The basis of equal rights guaranteed by the 14th amendment of the federal constitution to the states does delineate the specific right to birth control, the right to privacy or the right to marry a member of another race if the state in which they reside exercised their rights to ban any of those. Clearance Thomas just said that the 14th amendment protections for birth control, gay marriage and other rights judicially determined to exist and protect citizens from their state's laws are now also suspect because they too rely on the same interpretation of the 14th amendment that the right to privacy and abortion did. Thomas's list left out inter racial marriage but it too relies upon the exact same 14th amendment interpretation. So the point that he married a white woman should highlight his "right" to marry a white woman is now on shaky legal ground. Shaky because he undermined it.

In his own concurring opinion, Justice Brett Kavanaugh splits from Thomas, appearing to suggest that the Court's overturning of Roe will not affect the standings of past rulings, including Loving, Obergefell, and Griswold.
