First they have to bring him back into active duty to have jurisdiction over him.

Then the process goes like this:
Investigation: A JAG officer conducts a thorough investigation into alleged offenses, gathering evidence and witness testimony.
Charging: After the investigation, the JAG officer drafts the charges and specifications against the service member.
Referral to a convening authority: The charges are presented to a convening authority, a commanding officer who has the power to refer the charges for trial.
Trial: The convening authority may refer the case to a court-martial for trial, where the JAG officer will act as the prosecutor.

I hope they bring him back into active service and initiate the process.
I don't think it would make it to trial.
The JAG folks take a court martial pretty serious, and am not sure they are going to find officers who could be told to court martial a guy for reciting the UCMJ about duty to not follow illegal orders. Ironical.

I could see after getting back in uniform that Trump could get a Mike Flynn-ish admiral to give him an Admiral's Mast, but that is just a formal ass chewing that usually limits a military career.
Senator Kelly already had an outstanding military career.

But it wold be the perfect ending to this horseshit.

BTW - the only reason they are going after Sen. Kelly is because he is retired military, the others did not get full retirement and cannot be brought back into military service.
So he is a target because of his dedicated service to America as a wartime pilot, and astronaut.
