For those who are interested in the facts, a prosecutor almost always brings the most serious charges against a cooperator like Flynn. If you want to build a case against a higher up, you damn sure don't want to paint one of your future star witnesses as a liar, which is exactly what Mueller did here.

Flynn is a liar. Trump is a liar. Flynn was told to stay strong by Trump because Trump knew Flynn would be offered a plea deal in exchange for his testimony. If you are going to discount everything Flynn said because he pled guilty to lying to the FBI, you might want to consider that the FBI knew what the Truth was when they asked Flynn about his involvement with Kislyak. So Flynn's lies are his crime, the truth is Trump's crime.

Flynn's choice of lawyers has been interesting. His first choice sought the acknowledge the exposure, admit wrongdoing and cooperate out of a prison sentence. Pretty standard in federal court where there is no discovery and the government can compel any witness to testify or offer any co conspirator plea deals to testify. But then he changed his mind. He started to see how life as a disgraced convicted felon might not be the retirement he had in mind. He fired his lawyers, hired a former federal prosecutor fox pundit with a failed book about prosecutorial over reach and went on scorched earth tour ending with a request to vacate his guilty plea. He paid his savings and retirement to failed writer who recently reinvented herself as a deep state conspiracy theorist who had proof from the inside. She used Flynn to raise her profile and now he will go to prison because she wanted to fight the case in the court of public opinion instead of the court room.

Federal court is no place for indecision. Flynn had a good plan initially to cooperate and make his stand at sentencing. He abandoned that plan after he pled and hired an attorney more interested in putting herself on prime time fox than having her client eat his vegetables. She went scorched earth and even insinuated that the judge was part of this vast liberal left wing deep state conspiracy. Federal judges are dangerous at sentencing. This judge will not accept a plea unless Flynn says he is guilty so that there will not be a plea. Flynn has done that. Now he's like the pregnant girl teaching birth control as cautionary tale. The plea could be vacated but then the feds would supersede the indictment, add all those charges they passed on for the plea negotiations and go after his son for that bizarre plot to kidnap the Turkish cleric living in Pennsylvania that Erdogan believes was behind the failed coup. It will go very badly for Flynn and his lawyer. She thinks she fighting the case in the court of public opinion and she thinks the fox support will push her motions to dismiss through. They won't. The judge will have the final word after the government lays out their case and his lies as proof of the breach of the plea. He will go to prison. My guess is around four years.
